A Fulton County grand jury indicted 15-year-old Kroy Biermann Jr. on seven felony charges connected to an alleged sexual assault at a gym on North Point Parkway in Alpharetta.
The indictment, returned Thursday, Sept. 3, in Fulton County Superior Court, includes charges of aggravated child molestation, aggravated sexual battery, aggravated sodomy, false imprisonment and three counts of sexual battery against a child under 16, CBS News reported.
All seven counts stem from an alleged incident on April 23 at the Life Time Fitness location on North Point Parkway, according to Fox 5 Atlanta. Investigators allege Biermann met a 15-year-old girl at the facility's café before leading her into a family changing area, where the alleged assault occurred.
Biermann is the son of former Atlanta Falcons linebacker Kroy Biermann Sr. and former "Real Housewives of Atlanta" cast member Kim Zolciak.
An Alpharetta police officer was dispatched to North Fulton Hospital on April 24 after a report of sexual assault, according to a redacted incident report cited by Atlanta News First. The incident date listed in that report was April 23.
The indictment escalates the case beyond the initial arrest. Alpharetta police arrested Biermann on Aug. 17 and charged him as an adult with aggravated sodomy and aggravated sexual battery, WSB-TV reported. The grand jury added charges of aggravated child molestation, false imprisonment and three counts of sexual battery against a child under 16.
Biermann remains in custody. He is being held at the Metro Regional Youth Detention Center in Atlanta.
Defense attorney Jason Sheffield has maintained his client's innocence. In an Aug. 21 statement following the arrest, Sheffield said "my client is 100% innocent and tried to present evidence to the arresting officer, including a passed Polygraph … as well as evidence of other prior false allegations by the alleged victim."
Fox 5 reported that a medical examination found no male DNA on the accuser. Sheffield's Aug. 21 statement also cited that finding.
The Alpharetta Police Department has not issued a public statement on the indictment as of Sept. 4. A court hearing is scheduled for the week of Sept. 7, though reporting outlets differ on the exact date.
